SB 1277 — SB 1277 - This act requires each state department, within fifteen days of receiving a guidance document from the federal government, to publish the guidance document on a website designated by the department director. Each guidance document shall be published in a conspicuous manner with a hyperlink that provides access to the guidance documents. Within 15 days of a guidance document being rescinded, a state department shall maintain the rescinded guidance document on the website and indicate that the document has been rescinded along with the date that the guidance document was rescinded. SB 1165 — SB 1165 - This act requires the school board of each school district to establish a policy authorizing students to be excused from class to attend a course in religious or moral instruction taught by an independent entity off school property. Such instruction is defined in the act as a "released time course". The policy shall provide that students may be excused for up to three class periods per week or a maximum of 125 class periods per school year. The student's parent or legal guardian shall provide written consent prior to the student's participation in a released time course. No school district funds, except minimal administrative costs, shall be used, and no school personnel, equipment, or resources shall be involved in providing the instruction. The independent entity offering a released time course shall maintain attendance records and make them available to the school district and its board. Transportation to and from the instruction site shall be the responsibility of the independent entity, the student, or the student's parent or legal guardian. The independent entity or the student's parent or legal guardian shall indemnify and hold the school district harmless regarding any liability arising from student conduct that does not occur on school property under the district's control or supervision, and shall maintain adequate insurance for this purpose. The student shall be responsible for any missed school work. The school district superintendent, principal, or their designees shall have discretion over the scheduling and timing of released time courses, ensuring students are not excused during courses in English language arts, mathematics, science, or U.S. history. The school district, its school board, and the state shall not be liable for students participating in released time courses when the students are not under the district's control or supervision. For purposes of calculating average daily attendance and establishing compliance with the compulsory attendance law, a student attending a released time course shall be considered in attendance in the school district, and the time shall be counted as part of the school day. The school board shall award elective credit for work completed in a released time course, substantiated by a transcript from the independent entity providing the course. The evaluation of the course for credit should be neutral and secular, considering factors including classroom instruction time, course syllabus, assessment methods, and instructor qualifications. The provisions of the act shall not apply to charter schools or to virtual schools. This act is identical to SB 698 (2025) and similar to HB 2157 (2026) and HB 1393 (2025). SB 1174 — SB 1174 - Under current law, if the statements on any absentee ballot envelope have not been completed, the ballot must be rejected. This act stipulates that a ballot shall also be rejected if the: • Voter has failed to sign the oath; • Signature on the envelope does not appear to be valid; • Oath has failed to be verified; • Absentee ballot has been rejected for any other reason provided by law; or • Voter is otherwise found disqualified to vote. If one of the foregoing has been found by the election authority then the ballot shall be rejected and the election authority shall write "Rejected" on the face of the envelope and give the reason. The election authority must promptly notify any voter if his or her absentee ballot has been rejected and the deadline and procedures for curing the defect for which the ballot was rejected. SB 1364 — SB 1364 - Under this act, any nonprofit statewide association that facilitates interscholastic activities for secondary school students and that includes at least one public school district as a fee-paying member (defined as an "activities association") shall be overseen by a board of three directors appointed by the Governor, by and with the advice and consent of the Senate. The term of office of each director shall be four years. If the General Assembly is not in session when a position on the board of directors becomes vacant, the Governor shall make a temporary appointment. The board of directors shall have final decision-making power with respect to all actions of an activities association. Upon motion of any party, a matter may be transferred directly to the board at any time during the matter's pendency. Further, the board of directors shall have authority to remove any employee or member of an activities association, with or without cause, at such time and in such manner as the board shall deem proper. SB 1215 — SB 1215 - This act authorizes the sentencing court to reduce a sentence of life without eligibility for probation or parole or reduce a sentence of 30 years or greater to a sentence of life with eligibility for probation or parole if the convicted person has served at least 30 years, was under 20 years of age at the time of the offense, made reasonable efforts towards rehabilitation, and has exhibited model citizen behavior. Any offender receiving such reduction shall be granted a hearing before the Parole Board. Furthermore, an offender receiving a reduction shall provide the Parole Board the following in order to be eligible for supervised release: (1) At least 5 statements from current or former Department of Corrections employees attesting to the offender demonstration of institutional adaptability and conduct in the correctional center; (2) At least 20 signed statements from residents of the community where the offender will reside upon release that commit to providing assistance with the offender's reentry; and (3) A safe and secure home plan. SJR 89 — SJR 89 - This constitutional amendment, if approved by the voters, provides that, beginning January 1, 2027, the assessed value of residential real property shall be the most recent assessment. For all subsequent reassessments of such residential real property, the assessed value shall not increase while the owner or owners continue to own such property. Residential real property that is purchased, newly constructed, or undergoes a change in ownership shall be reassessed at its true value in money as provided by law, after which the assessed value of such property shall not increase while the new owner or owners continue to own such property. The assessed value of residential real property shall reflect the value added to the property as a result of new construction or improvements, as described in the act. SB 1162 — SB 1162 - Current law authorizes counties to adopt an ordinance allowing for the payment of property taxes in installments. This act requires that counties do so. (Sections 139.052 and 139.053) This act also requires that, prior to selling delinquent property for back taxes, a collector shall notify a taxpayer that the ability to pay delinquent taxes in installments is available to the taxpayer. (Section 140.120) Finally, current law authorizes a collector to sell delinquent property to satisfy delinquent taxes, interest, and penalties owed to the county. This act provides that a collector shall not commence such sale for a period of fifteen years following the date the property becomes delinquent. This provision shall not apply to delinquent property that is abandoned property, which is defined as property that is delinquent for three consecutive years and for which the collector is unable to contact the property owner. SB 1384 — SB 1384 - Under this act, charter schools and private schools that participate in the Missouri Empowerment Scholarship Accounts Program (defined as "private schools") shall be subject to the same procurement processes, wage standards, and contractual obligations as school districts. (Sections 160.405 and 166.706) No more than 10%, rather than 20%, of the full-time instructional staff of a charter school may be uncertified to teach in the public schools of this state. School districts are authorized to employ uncertified instructional personnel, as long as no more than 10% of a school district's full-time teaching positions are filled by uncertified personnel and certain other conditions are satisfied. Private schools shall employ only certified instructional staff, except that up to 10% of a private school's full-time teaching positions may be filled by uncertified personnel. (Sections 160.420, 166.706, and 168.011) Charter schools and private schools, in addition to school districts, shall be eligible for Innovation Waivers exempting them from certain requirements relating to assessments and accreditation. All school districts and charter schools shall be held to the same reporting standards on their Annual Performance Reports. (Sections 160.518, 160.522, and 166.706) The State Board of Education shall classify and accredit charter schools and private schools in the same manner that school districts are classified and accredited. All public schools, private schools, and charter schools shall be classified using the same assessment systems and accountability measures. (Sections 161.092 and 166.706) The governing body of a school district, private school, or charter school shall comply with all Missouri Sunshine Law requirements for public meetings, including providing advance public notice, and shall additionally provide online public access to all meeting minutes. (Sections 162.012 and 166.706) School districts, private schools, and charter schools shall display annual financial reports on their websites, including information about revenues, expenses, contributions, contracts, and personnel salary schedules. (Sections 162.015 and 166.706) Any charter school that accepts transferring students under any open enrollment program enacted by the General Assembly, as well as any private school, shall set its opening date each school year no earlier than 14 calendar days prior to the first Monday in September. SJR 65 — SJR 65 - Under current law, an initiative petition proposing a constitutional amendment must contain a single subject and matters properly connected therewith. This constitutional amendment, if approved by the voters, would additionally stipulate that an initiative petition proposing a constitutional amendment contains a single subject only if it does not extend beyond one sole purpose and only contains additions or changes that are necessary to effectuate a single legislative change. This provision is identical to SJR 56 (2024) and SJR 12 (2023). The amendment additionally provides that each initiative petition that has been approved to be circulated for signature gathering shall have a summary statement of the measure prepared. The summary statement shall not exceed 100 words and shall be a complete, concise, clear, and accurate statement of the measure. If a court of competent jurisdiction finds that a summary statement is not a complete, concise, clear, and accurate statement of the measure and that a complete, concise, clear, and accurate statement cannot possibly be written in one hundred or less words, the court shall prohibit the measure from being circulated for further signatures or, in the event that the measure has been certified to be placed on the ballot, the court shall order the measure to be removed from the ballot. SB 1313 — SB 1313 - This act requires all homeowners' associations to hold an election every ten years for the renewal of the association. Such election shall require an 85% majority vote of all members of the association approving the renewal. Any association failing to receive such approval shall be immediately dissolved and the member homeowners shall not be subject to any other association for a period of ten years unless approved by 85% of such homeowners. Any homeowners' association in existence for at least ten years as of August 28, 2026, shall hold the election required by the act by no later than December 31, 2026. SB 1177 — SB 1177 - This act creates new provisions governing digital assets. NATURE OF DIGITAL ASSETS AND THE UNIFORM COMMERCIAL CODE (Section 409.450) The act establishes the following digital assets, all defined in the act, as intangible personal property and subject to the Uniform Commercial Code, as follows: • Digital consumer assets are considered a general intangible; • Digital securities are considered a security; • Virtual currency is considered money. The act creates standards and methods for the perfection, possession, and control of the aforementioned digital assets. Provisions are created allowing banks to provide custodial services, as that term is defined in the act, for digital assets and governing the manner in which such services are rendered to customers. REGISTRATION OF DIGITAL ASSETS (Section 409.455) The act creates a process for registering digital assets with the Secretary of State (SOS). The lawful owner of any digital asset or the owner's agent may register the digital asset with the SOS if the owner is a resident of this state or, in the case of a business entity, if the entity is incorporated or organized under Missouri law. Provisions are included relating to the information needed to be included on any application and the fee to be submitted, not to exceed $500. Registration of any digital asset is for a period of 5 years and may be renewed for successive periods. Any person who files or registers any digital asset with the SOS by knowingly making any false or fraudulent representation or declaration, orally or in writing, or by any other means, shall be liable to pay all damages sustained in consequence of the filing or registration, to be recovered by or on behalf of the injured party in any court of competent jurisdiction. SB 1381 — SB 1381 - This act adds juvenile court services to the list of services that a child may need as grounds for a juvenile court's exclusive jurisdiction. Currently, a juvenile court shall not have exclusive jurisdiction of a proceeding involving a child fifteen years of age who is alleged to have violated a state or municipal traffic ordinance or regulation that does not constitute a felony. This act modifies the felony to be a dangerous felony. Current law permits a court in the circuit in which a violation of a state or municipal ordinance is alleged to have been committed by a person prior to reaching 18 years of age to assume jurisdiction over the case. This act requires such court to assume jurisdiction over such cases. Under this act, a prosecuting or circuit attorney may make a motion to transfer a matter before the juvenile court to a court of general jurisdiction in cases in which it is alleged that the juvenile officer failed to perform the proper risk and needs assessment. The juvenile court shall examine the risk and needs assessment for every child in detention prior to either releasing the child or ordering the child to be detained until a detention hearing. This act modifies the grounds under which a child may be held for detention to include situations in which the child is alleged to have repeatedly violated state or municipal laws during the immediate preceding sixty days that supports the good faith belief that the child will continue to violate state or municipal laws and will pose a risk to the safety and well-being of others if released. This act adds prosecuting and circuit attorneys to the list of persons able to make a motion to have a child certified as an adult in certain cases. Finally, this act modifies the risk and needs assessment performed by a juvenile officer for a child in the jurisdiction of the juvenile court as described in the act. SB 1270 — SB 1270 - This act requires public schools and charter schools that include any of grades 4-12 to make at least one type of feminine hygiene product, as provided in the act, available in each school building for use by female students at no cost. Each school board and charter school governing body shall adopt policies establishing procedures for the distribution of feminine hygiene products and guidance regarding the safe use of such products, as well as prohibiting the resale or misuse of feminine hygiene products that are distributed to female students in accordance with the provisions of the act. SB 1389 — SB 1389 - This act provides that any individual may bring a cause of action against a business entity that has a policy allowing for individuals of one biological sex into changing facilities or restrooms designated for use by the opposite biological sex and in which the individual's privacy or expectation of privacy was violated in a changing facility or restroom that matched the individual's biological sex by an individual of the opposite biological sex. The prevailing plaintiff shall be entitled to recover nominal, compensatory, and punitive damages along with costs and attorney's fees. As defined in this act, the terms "restroom" and "changing room" do not include a unisex restrooms or changing rooms. Additionally, it shall be an affirmative defense if the individual that was permitted entry into a changing facility or restroom that did not match that individual's biological sex was: (1) A disabled individual or a child under the age of 13 who was accompanied, escorted, supervised, or assisted by an adult of the same biological sex as the one the changing room or restroom was designated for use; (2) An employee or agent of the business entity that enters, after a clear and understandable oral notice, to clean the room or secure or ensure the safety or well-being of individuals within the room; or (3) A first responder in the lawful performance of his or her duties.
